Principal employer contractor risk check: how exposed are you to a contractor's PF default?

If you use security guards, housekeeping or manpower from a contractor, EPFO can hold you liable for their PF when the contractor is unregistered or doesn't deposit. Eight questions, then a risk level and the monthly document list.

Principal employer contractor risk check

Answer for one contractor. Run it again for each.

Does the contractor have its own PF registration (establishment code) and have you seen it?
Do you receive the contractor's ECR each month, with the workers deployed at your site identifiable in it?
A summary or a certificate is not an ECR.
Do you receive the TRRN and the paid challan for that ECR each month?
Do you see the contractor's wage register for your site every month?
Do you reconcile the ECR headcount and wages with your gate attendance and the invoice?
Do you hold a UAN list for every contract worker on site, with Aadhaar-seeded UANs?
Does the contractor hold a valid contract-labour licence for your site, and do you hold your registration as principal employer?
Applies where the contract-labour thresholds are met.
Is payment release linked to receiving and checking these documents?

The monthly document set

What a principal employer should hold for each contractor, every month, before paying the invoice.

  1. Contractor's PF establishment code and ESIC code (once, then on any change).
  2. ECR for the wage month, with the workers deployed at your site identifiable (UAN, name, wages).
  3. TRRN and the bank-paid challan for that ECR.
  4. Wage register and attendance for your site, signed by the contractor.
  5. UAN list with Aadhaar-seeding status for every worker on site; joiners and leavers marked.
  6. ESIC monthly contribution challan, where ESIC applies.
  7. Contract-labour licence (contractor) and registration certificate (you), valid for the period and headcount.
  8. A one-page reconciliation: invoice headcount = attendance = ECR, signed by whoever releases payment.

Questions about this tool

Is a compliance certificate from the contractor enough?

No. A certificate is a statement. Evidence is the ECR with your site's workers in it, the TRRN and the challan for that month, matched to attendance and the wage register.

What if the contractor has no PF code?

Then their workers' PF is, in practice, your problem: EPFO treats the principal employer as responsible. Either the contractor registers now or you deposit under your own code until they do.

How often should the evidence be collected?

Every month, before you release that month's payment. A once-a-year audit finds a year of defaults you can no longer recover from the contractor.

Does this apply to small contractors below 20 workers?

Coverage thresholds apply to the contractor's establishment, and the principal employer's own coverage can bring contract workers in. Treat it as applying unless I have confirmed otherwise for your case.
