EPF Scheme 2026 replaced the 1952 Scheme: what actually changed for employers

The Employees' Provident Funds Scheme, 2026 replaced the 1952 Scheme on 29 June 2026. Most of the monthly routine is the same. Three things are not: the principal employer's duties for contract labour are spelt out with their own forms and timelines, returns run on a fifteen-day clock, and exempted establishments get a tighter rulebook. Here is what each one changes in practice.

Action box
Who it affects
Every employer covered by the EPF Act; especially principal employers using security, housekeeping or manpower contractors, and exempted establishments with their own PF trust.
What to do
Before the October ECR: declare every contractor in Form X on the portal, collect each contractor's Form XI for October by 10 November, verify the ECR and TRRN evidence, file the Form XII abstract by 20 November, and add the fifteen-day and twenty-day dates to your calendar.
Deadline
The October 2026 ECR due date (paragraph 20: within fifteen days of the close of the month). The Form XII abstract for October is due by 20 November.
Penalty if missed
Contributions on contract labour where the contractor's establishment is not independently registered are the principal employer's to pay; unpaid amounts are assessed in an inquiry under section 125 of the Code (section 7A of the old Act) with damages under paragraph 23 and interest under section 127. Missed returns and forms invite a notice and action under the Code.

Short answer

What did the EPF Scheme 2026 change for employers?

Three things in practice. The principal employer must register, declare every contractor in Form X and file a monthly abstract in Form XII within twenty days, and remains responsible for contributions on contract labour where the contractor's establishment is not independently registered. Returns run on fifteen days: a consolidated Form V within fifteen days of the Scheme applying, and monthly uploads of joiners and transfers within fifteen days of the month end. Exempted trusts get a tighter rulebook. Rates, the ₹25,000 ceiling, ECR and UAN are unchanged.

Quick summary
What changed
The Employees' Provident Funds Scheme, 2026 (G.S.R. 525(E), notified 29 June 2026) superseded the Employees' Provident Funds Scheme, 1952. It restates the rules in one text, spells out the principal employer's and contractor's duties with Forms X, XI and XII, puts returns on a fifteen-day clock, and tightens the conditions on exempted establishments.
Effective from
On publication in the Gazette; the notification is dated 29 June 2026 and EPFO applied it from 1 July 2026.
Who is affected
Every establishment covered by the EPF Act, with the largest practical change falling on principal employers who use contractors and on exempted establishments with their own trust.
What you need to do
Register and declare every contractor in Form X, collect each contractor's Form XI by the 10th, file the Form XII abstract by the 20th, keep the monthly uploads of joiners and transfers inside fifteen days, and if you run an exempted trust, review it against the new conditions.

What changed

According to Gazette notification G.S.R. 525(E) dated 29 June 2026, made under section 15 of the Code on Social Security, 2020, the Employees' Provident Funds Scheme, 2026 supersedes the Employees' Provident Funds Scheme, 1952, except for things done before the supersession. It came into force on publication, and EPFO applied it from 1 July 2026. The 1952 Scheme had been amended so many times that reading it meant reading seventy years of patches. The 2026 Scheme restates the rules in one text.

For most employers the monthly routine does not move. Three things do.

1. Contract labour: the principal employer's duties are spelt out. The 1952 Scheme relied on the Act and on EPFO's practice to reach a principal employer. The 2026 Scheme says it directly. Paragraph 20 makes the employer pay, in the first instance, both shares for employees employed directly or through a contractor where the contractor's establishment is not registered independently, and adds that the principal employer remains responsible for contributions on contract labour regardless. Paragraph 27 then gives the mechanics: the principal employer registers and declares every contractor in Form X; the contractor is jointly and severally liable; the contractor sends the principal employer a Form XI statement of each contract worker's UAN, wages and contributions within ten days of the month end; and the principal employer files a Form XII monthly abstract with the Commissioner within twenty days. If you use security guards, housekeeping staff or any manpower contractor, this is the change to read first. I have written it up separately in principal employer PF liability under the 2026 Scheme.

2. Returns on a fifteen-day clock. Paragraph 24 requires a consolidated return in Form V within fifteen days of the Scheme applying to the establishment (a nil return if nobody qualifies), and, within fifteen days of the close of each month, an electronic upload of employees who qualified for membership for the first time and of transfers in by UAN linkage. Contributions are likewise due within fifteen days of the month end under paragraph 20. The ECR continues; these are the returns around it, and each needs a line in your compliance calendar with an owner.

3. Exempted establishments. The chapter on exempted establishments requires the employer to comply with sections 16, 125, 128 and 129 of the Code, to intimate the Regional PF Commissioner of specified changes, and to run the trust under the board-of-trustees guidelines the Central Board issues. Trusts that have operated on income-tax recognition without a formal exemption notification can regularise under AMNESTY 2026.

Who this doesn't help

This post does not cover the ₹25,000 wage-ceiling change. That came by a separate notification and has its own practical questions, answered in October 2026 ECR under the ₹25,000 ceiling. It also does not help an employee whose own record is wrong; the employee guides start at PF claim rejected.

Who is affected

  • Every covered establishment, because the scheme text you are complying with has changed, even where the rule did not.
  • Principal employers using contractors, who now carry stated liability for contract labour PF where the contractor failed.
  • Exempted establishments, whose trust conditions have been rewritten.
  • Contractors themselves, especially security agencies and manpower suppliers, because their clients will now ask for evidence every month rather than once a year.

The employer with twenty staff and no contractors will notice almost nothing beyond the new return. The factory with four contractors on site has real work to do.

What to do

  1. List and declare every contractor supplying workers to your premises, with their EPFO establishment code, in Form X on the portal. No code means the contractor's establishment is not independently registered, and paragraph 20 then puts the contributions on you in the first instance.
  2. Collect three months of evidence from each: ECR, TRRN receipt and the wage register for the workers deployed to you. A compliance certificate is not evidence.
  3. Run each contractor through the contractor risk check to see where you stand and which documents to collect monthly from now on.
  4. Add the dates to your calendar with an owner: contractor's Form XI by the 10th, contributions and the monthly membership upload by the 15th, Form XII abstract by the 20th, and Form V once within fifteen days of the Scheme applying.
  5. If you run an exempted trust, put the trust deed, board composition and last audited accounts against the new governance conditions, and list the gaps.
  6. Keep the old scheme's circulars you have relied on. Where the 2026 text carries the same rule they still help; where it changed, note the difference.

What this does not change

  • Contribution rates: 12% employee, 12% employer, split 8.33% to EPS and 3.67% to EPF, within the wage ceiling.
  • The monthly ECR, with contributions due within fifteen days of the close of the month.
  • UAN, KYC and the member-side processes for claims, transfers and corrections.
  • Damages for late payment, now at paragraph 23's rate of 0.25% to 1% of the arrears per month by length of delay, and interest under section 127 of the Code (section 7Q of the old Act).
  • EPFO's power to hold an inquiry under section 125 of the Code (section 7A of the old Act) to assess dues.

Anything that was already a problem in your PF compliance is still a problem. The scheme restates obligations; it does not wipe old ones.

What you can do yourself for free

What you can do yourself for free

Everything here is free and done on EPFO's own services. NidhiSetu is independent and not affiliated with EPFO; EPFO's own services are free.

  • Read the 2026 Scheme in the Gazette; keep a copy with the notification date.
  • On the employer portal, check each contractor's establishment code and whether their ECRs are being filed.
  • Download your own ECR and TRRN receipts for the last six months and file them where an inspector can see them.
  • Use Shram Suvidha to check licences and returns that overlap with contract-labour compliance.
  • If a question about the new return goes unanswered, raise it on EPFiGMS under the employer category.

When specialist help may be useful

  • A contractor cannot produce ECR evidence for workers on your site and you need to know your exposure before the next payment run.
  • Your exempted trust is behind on several conditions and you need to decide between regularising and surrendering.
  • A 7A notice has already arrived citing contract labour.
  • You want the whole set-up, contractors, returns and trust, reviewed once and turned into a monthly routine, which is what my contractor compliance and PF / EPFO compliance work covers.

Need help working out what the new scheme means for your establishment?

Most of the 2026 Scheme is the 1952 Scheme with the numbering tidied up. The risk is in the parts that are new, and they land unevenly: a factory with four contractors has a very different exposure from a software company with none.

I help employers map the scheme to their own set-up: which contractors need evidence every month, what the 15-day return means for their filings, and, for exempted establishments, what the trust must change. Fee, scope and timeline go in writing before any work.

Questions people ask

Do the contribution rates change under the EPF Scheme 2026?

No. Employee and employer contributions stay at 12% of PF wages, with the employer's share split 8.33% to pension and 3.67% to PF, subject to the wage ceiling. The ceiling change to ₹25,000 came through a separate notification on 17 September 2026.

What is the fifteen-day return?

Two things in paragraph 24. A consolidated return in Form V within fifteen days of the Scheme applying to the establishment (a nil return if nobody qualifies), and, within fifteen days of the close of each month, an electronic upload of the employees who became members for the first time and of transfers in by UAN linkage. Contributions themselves are also due within fifteen days of the month end under paragraph 20.

What are Forms X, XI and XII?

Form X is the principal employer's registration and declaration of every contractor engaged. Form XI is the contractor's monthly statement to the principal employer, within ten days of the month end, of each contract worker's name, UAN, wages and contributions. Form XII is the principal employer's monthly abstract to the Commissioner, within twenty days of the month end, of recoveries and contributions for contract workers. Where EPFO's portal captures the same information, the compliance is deemed made.

We pay our contractor's invoice in full. Why would we be liable for their PF?

Paragraph 20 makes the employer pay, in the first instance, both shares for employees employed directly or through a contractor where the contractor's establishment is not registered independently, and says the principal employer remains responsible for contributions on contract labour notwithstanding anything else. Paragraph 27 makes the contractor jointly and severally liable with you. Paying the invoice is not evidence that the contractor paid PF; their ECR and TRRN are.

Our establishment is exempted and runs its own trust. What changes?

Chapter on exempted establishments: the employer must comply with sections 16, 125, 128 and 129 of the Code, intimate the Regional PF Commissioner of specified changes, and run the trust under the board-of-trustees guidelines the Central Board issues. Trusts that have run on income-tax recognition without a formal exemption notification can use AMNESTY 2026.

Do old circulars under the 1952 Scheme still apply?

The 2026 Scheme supersedes the 1952 Scheme except for things done before supersession. Circulars that interpret provisions carried into the 2026 text still help; where the 2026 text changed the rule, the new text prevails. When in doubt, ask the regional office in writing.
